Terms and Conditions of People 4 BV, located at Westzijde 178, 1506EK Zaandam

Article 1: Applicability

1.1 The website www.people4official.com is owned by People 4 Bv, registered with the Chamber of Commerce in Zaandam. 1.2 These terms and conditions apply to all offers, deliveries, and agreements made, executed, or entered into by People 4, unless agreed otherwise in writing. 1.3 Acceptance of an offer and/or assignment explicitly implies the applicability of these general terms and conditions, whereby the customer waives any applicability of their own terms. The customer may not invoke customary law.

Article 2: Offers

2.1 All offers from People 4 BV are non-binding unless explicitly stated otherwise by People 4 BV in writing. 2.2 Orders and amendments are only binding once accepted or confirmed by People 4 BV, whether in writing or not. Regardless of the above, an offer will expire after five days from the date of the offer. 2.3 For bundled price quotes, there is no obligation to deliver a part of the total price. 2.4 Unless agreed otherwise, prices for delivery are ex-works (not including shipping). 2.5 Price quotes are based on the prices at the time of the offer and are valid only on the day of the offer. If, after the date of the offer, any cost factors increase, People 4 BV is entitled to raise the quoted price accordingly. However, People 4 BV will notify the customer in writing and give a 7-day period to cancel the agreement in writing. If the price increase occurs after the agreement has been concluded, People 4 BV is obligated to deliver at the agreed price. If the price increase is due to a legal VAT rate increase, People 4 BV is entitled to raise the offered price accordingly. 2.6 Each offer is, unless explicitly stated otherwise, based on delivery under normal conditions and during normal working hours.

Article 3: Payment/Prices

3.1 All prices are subject to (type) errors. 3.2 All prices are exclusive of shipping costs and inclusive of VAT unless stated otherwise. 3.3 Payment of the sale amount must be made at the time of ordering the product, without the possibility of suspension, compensation, or deduction, unless explicitly agreed otherwise. 3.4 If an invoice is sent for the purchase amount, a payment term of 14 days applies. Upon receipt of full payment, the order will be processed or delivered, if in stock. 3.5 Deviations in payment terms are only valid if agreed upon in writing between People 4 BV and the customer. 3.6 Unless proven otherwise, the correctness of the invoices and invoice overviews prepared by People 4 BV shall be assumed. 3.7 If the customer does not pay within the agreed payment term, they are considered in default by operation of law. People 4 BV has the right to charge the customer the full amount due, including statutory interest, plus a 10% surcharge, starting from the invoice due date. All collection costs, both judicial and extrajudicial, resulting from non-payment by the customer, are for the account of the customer. Extrajudicial collection costs amount to 15% of the principal sum with a minimum of €150. 3.8 People 4 BV is always entitled, regardless of the agreed payment conditions, to request sufficient security for payment and to suspend the performance of the agreement if this security cannot be provided. In such cases, the customer can choose between paying in cash for the goods to be delivered, offsetting any advance payment, or canceling the agreement, in accordance with article 3.10. 3.9 Payments made by the customer to People 4 BV will always be applied to settle the oldest outstanding amount, including interest and costs. 3.10 If payment is not made at the time of delivery, People 4 BV may withhold delivery. If People 4 BV does not proceed with delivery, the customer must pay transport costs and an amount of €5 per day, or part of a day, until delivery takes place, as compensation for storage costs.

Article 4: Transfer of Ownership, Risk, and Delivery

4.1 Delivery is considered the actual provision of goods to the customer or persons within the customer's risk sphere. The risk for the purchased goods is transferred to the customer once the goods are delivered to the address specified by the customer. People 4 BV is not liable for any indemnification, however named. 4.2 Ownership of the delivered goods is transferred to the customer only after the purchase price, including any interest and costs, has been paid in full. The transfer of ownership does not occur by mere transfer of the goods. If the customer transfers, uses, or pledges the delivered goods that have not been fully paid, or in the case of bankruptcy or suspension of payments, or if a seizure occurs, and the customer does not inform People 4 BV of this within 5 days, the customer forfeits a penalty of at least three times the unpaid amount, not subject to mitigation. 4.3 The general delivery time for products is 1 to 3 working days. The maximum delivery time for remote purchases is 30 days. If a product has a longer delivery time, this will be explicitly stated. If People 4 BV cannot meet the delivery time, the customer will be informed in advance. A new delivery date will be arranged, or the customer has the right to cancel the agreement. Any amounts already paid will be refunded by People 4 BV within 30 days after the cancellation.

Article 5: Complaints, Claims, and Warranty

5.1 If goods with visible damage are delivered by People 4 BV, the customer must file a complaint directly or within 24 hours after receiving the goods. For goods that are processed or modified by the buyer, the buyer must verify their condition upon receipt. If the damage or defect is not visibly apparent, the customer must report it in writing within two weeks of receiving the goods or completion of work. The complaint must describe the observed defects or damages. 5.2 Minor deviations in quality, quantity, width, colors, finish, size, workmanship, etc., that are generally acceptable in trade or technically unavoidable, do not provide grounds for complaints, nor do color deviations from samples or swatches. If the customer confirms the delivered hair extensions by People 4 BV, they must check the condition before confirmation. After confirmation, any claims for warranty or deviations are no longer valid. 5.3 Complaints on invoice amounts must be submitted in writing within 5 working days from the invoice date by registered mail. 5.4 Complaints submitted to intermediaries or resellers, or later directed to People 4 BV, are not valid and will have no legal effect. 5.5 Any complaint right expires if the above deadlines are not adhered to, or if third parties have performed work on goods or materials for People 4 BV. 5.6 Complaints do not grant the customer the right to apply compensation or set-off. 5.7 Unless explicitly agreed by People 4 BV, the customer may not return items purchased from our online store, shop, or salon. 5.8 If the manufacturer of the delivered goods offers a further warranty to People 4 BV, this warranty will also apply to the customer if the supplier determines that the complaint is justified. 5.9 Warranty provisions are only valid when the goods or work are used as intended. Careless handling or insufficient care by the customer excludes any complaints and invalidates any warranties or other guarantees.

Article 6: Liability

6.1 People 4 BV is never liable for direct or indirect damage, business or consequential loss, including delays in delivery due to defects in the goods delivered by People 4 BV, except in cases of intent or gross negligence by People 4 BV. 6.2 People 4 BV is not obligated to compensate any damages of any kind or cause beyond the total transaction amount between People 4 BV and the customer. 6.3 The customer indemnifies People 4 BV from any third-party claims, including the customer’s personnel, for compensation for any damage suffered by these third parties in any form. 6.4 Any complaint right expires if the above deadlines are not adhered to. 6.5 Complaints do not grant the customer the right to suspend fulfillment of their obligations or apply compensation or set-off.

Article 7: Cooling-Off Period

7.1 The customer who has purchased products online via the webshop, and after receiving the ordered product, has the right to cancel the agreement with People 4 BV within fourteen (14) days after receipt of the product. The customer is not required to provide a reason for this cancellation. 7.2 If the customer wishes to cancel the agreement pursuant to article 7.1, they must inform People 4 BV in writing (via email or letter). The customer must return the product to a return address specified by People 4 BV, in its original, undamaged packaging. Opened or used products will not be accepted for return. Hygiene products that are sealed cannot be returned if the seal or sticker is removed. The customer is responsible for the cost and risk of shipping the product back. 7.3 If the customer has made any payments, People 4 BV will refund the customer within fourteen (14) days after receiving the returned product. 7.4 People 4 BV reserves the right to refuse returned products or only credit part of the paid amount if the product is damaged due to the customer’s actions or negligence. 7.5 If a product is returned that People 4 BV deems damaged due to customer fault, People 4 BV will notify the customer in writing. People 4 BV may withhold the depreciation of the product from the refund amount.

7.6 The customer has the right to cancel the order within 14 days after receipt without providing a reason. After cancellation, the customer has another 14 days to return the order. The customer will be refunded the full order amount, including shipping costs. Only the return shipping costs are the customer's responsibility. These costs are approximately €6.95 per package (for exact rates, refer to the carrier's website you intend to use). If the right of withdrawal is exercised, the product must be returned to People4hair.nl with all provided accessories and, if reasonably possible, in its original condition and packaging. Opened and/or used products will not be accepted for return. The consumer has no right to cancel the purchase of goods that are not suitable for return for reasons of health protection or hygiene, and which have had their seal broken after delivery. 7.7 Agreements with business customers do not have this cooling-off period.

Artikel 8: Force Majeure / Niet-toerekenbare tekortkomingen

8.1 Als voor of tijdens de uitvoering van de overeenkomst blijkt dat de verdere uitvoering van de overeenkomst voor People 4 BV niet mogelijk is door overmacht, heeft People 4 BV het recht om de uitvoering van de overeenkomst op te schorten of de overeenkomst te ontbinden, zonder dat People 4 BV gehouden is tot schadevergoeding. 8.2 Onder overmacht wordt verstaan elke omstandigheid buiten de controle van People 4 BV die de normale uitvoering van de overeenkomst verhindert. Dit kan onder andere weersomstandigheden omvatten, maar ook stakingen, oorlogen, molest, brand- en waterschade, defecten aan machines, belemmeringen of vertragingen in het transport van materialen of goederen die geleverd moeten worden, overheidsmaatregelen en de gevolgen daarvan. Tevens wordt als overmacht beschouwd het niet of niet tijdig voldoen aan de verplichtingen door de leveranciers van People 4 BV en andere gebeurtenissen die buiten de controle van People 4 BV vallen, waaronder ziekte van het personeel van People 4 BV, haar leveranciers of derden die zij inschakelt.

Article 9: Termination

9.1 If the buyer does not, does not properly, or does not timely fulfill any obligation, or in the event of bankruptcy or suspension of payments of the customer or their business, the buyer is deemed to be in default by operation of law. People 4 BV has the right, without any notice of default and without judicial intervention, to suspend the performance of the agreement or to terminate the agreement in whole or in part, at its discretion, without being obligated to pay any compensation or guarantee, without prejudice to the rights to which People 4 BV is entitled. In these cases, any claim that People 4 BV has or will have against the customer is immediately and fully due and payable. 9.2 The business customer is obligated to actually accept the ordered goods. If the customer cancels an order, for any reason, they owe People 4 BV compensation of 25% of the amount the customer would have had to pay if the agreement had been performed, unless People 4 BV wishes to enforce performance. This is without prejudice to People 4 BV's right to compensation for lost profits and any damage caused by the cancellation.

Article 10: Disputes

The judicial authorities in the district of Utrecht have exclusive jurisdiction to hear disputes between People 4 BV and its customers.

Article 11: Applicable Law

Dutch law applies to all offers and agreements made or entered into by People 4 BV.

Article 12: Terms and Conditions People 4 Official Giftcard

The P4H Giftcard is the perfect gift to surprise someone. For a birthday, Sinterklaas, Christmas, or just because. Below are all the terms and conditions applicable to the P4H Giftcard.

The giftcard can be redeemed after being topped up with an amount of money in any P4H Partner salon in the Netherlands or in the Online Shop.

Online, you can choose from a giftcard with one of the following eight amounts: 10, 15, 20, 25, 35, 50, 75, or 100 euros.

The balance on the giftcard is valid indefinitely and can be spent all at once or in parts.

The giftcard is NOT exchangeable for cash and is NOT reloadable.

People 4 Official is in no way liable for theft, loss, forgery, or misuse of the giftcard. This does not mean we cannot assist you. If your giftcard is stolen or lost, please contact our customer service. Email us at and include the following as attachments:

  • A photo of the purchase receipt for the P4H Giftcard, or

  • A photo of the bank statement showing where and when the giftcard was purchased.

With this information, we can trace the giftcard number and check if the balance can be transferred to a new giftcard.

If your giftcard is damaged, you can exchange it for a new giftcard with the same balance, free of charge, as long as the relevant codes are still legible. People 4 Official reserves the right to refuse payment with the giftcard if payment is not possible, for example due to a technical issue.

Article 13: Final Provision

If any provision of these general terms and conditions is found to be invalid or void, the remaining provisions of these terms and conditions shall remain fully in effect, and People 4 BV and the customer will consult to agree on new provisions to replace the invalid or void provisions, taking into account as much as possible the purpose and intent of the invalid or void provision.
